These Terms of Service govern your use of IRON LINK. By creating an account or using the Platform, you agree to these terms. Please also review our Privacy Policy.
1. Acceptance of Terms
By creating an account, logging in, or otherwise using IRON LINK ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use the Platform.
2. Eligibility & Account Registration
You must be at least 18 years of age and legally able to enter into binding contracts to use this Platform. You represent and warrant that you are 18 or older. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
3. User Conduct & Acceptable Use
You agree not to: (a) post false, misleading, or fraudulent content; (b) impersonate another person or misrepresent your qualifications, certifications, or trade experience; (c) harass, discriminate against, or threaten other users; (d) post content that is unlawful, harmful, defamatory, or infringes the rights of others; (e) use the Platform for any illegal or unauthorized purpose; or (f) attempt to disrupt, overload, or gain unauthorized access to the Platform or its systems.
4. Professional Listings & Marketplace
IRON LINK includes an equipment marketplace and job board. When you list equipment, post a job, or respond to a listing, you are solely responsible for the accuracy of your listings, the legality of the transaction, and compliance with all applicable laws. We do not guarantee the quality, safety, or legality of items sold, nor do we verify the identity or qualifications of every user. Transactions are arranged directly between users at their own risk. IRON LINK acts solely as a platform that connects buyers and sellers; we are not the seller of record in any equipment transaction, we do not collect or process payment for the items sold, and we are not a "marketplace facilitator" under Alabama's Simplified Sellers Use Tax (SSUT) rules or similar laws. We do not collect, remit, or assume responsibility for sales, use, excise, or similar transaction taxes on transactions between users. Buyers and sellers are each solely responsible for determining and fulfilling their own tax obligations, including any applicable Alabama state, county, and local taxes arising from a sale.
5. Equal Opportunity Employment
Employers using IRON LINK to post jobs must comply with all applicable U.S. federal, state, and local fair employment laws, including Title VII of the Civil Rights Act and the regulations of the U.S. Equal Employment Opportunity Commission (EEOC). Job postings may not discriminate on the basis of race, color, religion, sex (including pregnancy, sexual orientation, or gender identity), national origin, age (40 or older), disability, or genetic information. IRON LINK reserves the right to remove any job posting that, in our discretion, violates these requirements or otherwise appears discriminatory.
6. Payments, Fees, Cancellation & Refunds
Certain features, such as equipment listings, ad campaign purchases, and business subscriptions, require payment. Payments are processed through our third-party payment provider (Stripe). You authorize us to charge the applicable fees for the plan or listing you select. One-time listing fees are non-refundable except where required by law. Recurring business subscriptions (e.g., monthly plans) auto-renew until you cancel; you may cancel a subscription at any time from your account settings, and cancellation stops future billing at the end of the current paid period. We may change our pricing at any time, with notice where required. To request a refund where legally required, contact us through the contact options available on the Platform.
7. Content & Intellectual Property
You retain ownership of content you post, including posts, portfolio images, and profile information. By posting content, you grant IRON LINK a worldwide, royalty-free, non-exclusive license to use, reproduce, display, and distribute that content in connection with operating and promoting the Platform. You represent that you have all rights necessary to post your content and that it does not violate any third-party rights.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform you consent to the data practices described in that policy.
9. Disclaimers & Limitation of Liability
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, IRON LINK and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Platform.
10. Termination
We may suspend or terminate your account at any time, with or without cause or notice, if we believe you have violated these Terms or applicable law. You may stop using the Platform at any time. Upon termination, your right to use the Platform ceases immediately.
11. Copyright & DMCA Takedown
We respect intellectual property and respond to valid notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). If you believe content on IRON LINK infringes your copyright, send a written notice to our designated copyright agent including: identification of the copyrighted work, identification of the allegedly infringing material (with its location on the Platform), your contact information, a statement that you believe in good faith the use is unauthorized, and a physical or electronic signature. Submit notices through the contact options available on the Platform, referencing "DMCA Notice." We will process and respond to valid notices in accordance with applicable law, and may terminate accounts of repeat infringers.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the version date and, where required, notify you. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Platform.
13. Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. Any disputes arising under or relating to these Terms or your use of the Platform shall be resolved in the state or federal courts located in the State of Alabama, and you consent to the exclusive jurisdiction and venue of such courts.
